Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the website molokofest.live (the "Site") operated by MoLoKo ("we," "us," or "our"), as well as your attendance at MOLOKO UKRAINIAN FESTIVAL (the "Festival"). By accessing the Site or purchasing a ticket, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the Site, submitting an application, or purchasing a ticket, you confirm that:

  • You are at least 18 years old, or you are using the Site with parental/guardian consent.
  • You agree to these Terms and our Privacy Policy.
  • You will provide accurate, current, and complete information when prompted.

2. Site Use

You agree not to:

  • Use the Site for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to our systems or other users' data.
  • Upload viruses, malware, or any harmful code.
  • Scrape, copy, or republish content without our express written permission.
  • Impersonate any person or misrepresent your affiliation with any person or entity.
  • Interfere with the Site's normal operation or other users' enjoyment.

3. Applications (Artists, Sponsors, Vendors)

  • Submission of an application does not guarantee selection.
  • We review all applications and respond at our discretion.
  • You confirm that any material you submit (samples, photos, biographies, logos) is your own or you have permission to use it.
  • By submitting, you grant us a non-exclusive, royalty-free license to use submitted materials for festival programming, marketing, and promotional purposes.

4. Tickets

Purchase

Tickets are sold through our external ticketing partner. All ticket purchases are subject to that partner's terms and conditions in addition to these Terms.

Refunds & Transfers

  • All ticket sales are final. Tickets are non-refundable except where required by law.
  • Tickets are transferable up to 48 hours before the start of the Festival.
  • In the event of Festival cancellation, refund procedures will be communicated via email and on the Site.
  • Postponement, rescheduling, or lineup changes do not entitle the holder to a refund.

Entry conditions

  • Festival staff may search bags upon entry.
  • Prohibited items include outside alcohol, weapons, professional cameras, drones, and illegal substances.
  • We reserve the right to refuse entry or remove anyone for unsafe, illegal, or disruptive behavior — without refund.
  • Photo ID matching the ticket name may be required.

5. Intellectual Property

The Site and its original content — including the MoLoKo name, logo, design, photography, video, and text — are the property of MoLoKo and its licensors, and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not use any of our trademarks or branding without prior written consent.

6. User-Submitted Content

If you submit content to us (via applications, social media tags, or otherwise), you represent that you own or have the rights to that content, and you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display it in connection with festival marketing and operations.

7. Photography and Recording at the Festival

By attending the Festival, you consent to being filmed, photographed, or recorded by festival staff or authorized media. You grant us irrevocable permission to use your likeness in promotional materials, social media, and future festival communications without compensation.

8. Disclaimers

The Site is provided "as is" and "as available", without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, MoLoKo, its officers, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of, or inability to use, the Site or the Festival.
  • Lost data, lost revenue, or lost profits.
  • Damage to property, personal injury, or any other harm related to the Festival, except where caused by our gross negligence or willful misconduct.
  • Acts of God, weather, force majeure, or third-party actions outside our reasonable control.

Our total liability for any claim arising from these Terms or your attendance at the Festival is limited to the amount you paid for the ticket(s), if any.

10. Indemnification

You agree to defend, indemnify, and hold harmless MoLoKo and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your violation of these Terms, your conduct at the Festival, or your infringement of any third-party right.

11. Newsletter

By subscribing, you consent to receive periodic emails from us about the Festival. You can unsubscribe at any time via the link in any email or by contacting us.

12. Third-Party Links

The Site may contain links to third-party websites (ticketing partners, sponsors, social media). We are not responsible for the content, privacy practices, or terms of those sites.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois, for any dispute arising from these Terms or the Festival.

14. Changes to These Terms

We may revise these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
